Is embalming required by law?

Embalming is not required by New York State law. However embalming is required when the remains will be transported from one state to another by common carrier or as a result of a reportable contagious disease.


Is a vault required?

The use of an outer receptacle is not required by New York State law. Some cemeteries do require an outer protective receptacle for the casket to be placed into. The most common are either made of concrete, metal or wood. The casket is often placed in an outer receptacle to protect the remains and casket during the back filling of the grave which is done by heavy machinery as well as to keep the earth from sinking.
